"Unauthorized Use of Bill O'Reilly's Column"

March 2, 2005 8:01 PM

I got a letter today from Creators Syndicate and a bunch of their lawyers. The company syndicates Bill O'Reilly's column. I'd post the entire thing here, but I can't, and here's why: "Creators Syndicate demands that you immediately cease and desist from your unauthorized use of the Bill O’Reilly column."

Funny thing is, I haven't used Bill's columns in any unauthorized way. Turns out that what they are referring to is a blog post from one of the News Hounds yesterday. All I do is host and maintain the site -- I have no control over the content, yet I'm the one responsible for getting this removed simply because my name shows up in the whois registry?

Apparently so. Thankfully, I'm good friends with the News Hounds, and this isn't a big deal to resolve, but now I have to worry about protecting myself in the future.

Fair Use is under continuous attack. What disturbs me is that even though an individual or organization may be in the right, it's difficult to stand toe-to-toe in court with a plaintiff who can outspend you by three orders of magnitude.

Lawrence Lessig's blog (click my name - http://www.lessig.org/blog/), and EFF (http://eff.org) are good resources regarding our rights online.
